During a trademark dispute involving Yulu, a Bengaluru court stops Kinetic Green’s “Zulu” e-scooter

The legal conflict began in late January when Yulu filed a lawsuit against Kinetic Green in a municipal civil and sessions court. Yulu claimed that Kinetic Green had infringed its trademark when it introduced "Zulu" branded e-scooters in mid-December 2023.

A provisional injunction against Kinetic Green Energy, which forbids them from using, selling, or advertising under the “YULU” trademark or any confusing versions like “ZULU” and “Kinetic Green Zulu,” has been confirmed by a commercial court in Bengaluru. This ruling comes after the High Court of Karnataka imposed a comparable temporary injunction on February 5 and directed the commercial court to accelerate the hearing procedure.

The legal dispute started in late January when Yulu filed a case in a municipal civil and sessions court, claiming that Kinetic Green had violated their trademark when they introduced their “Zulu” branded e-scooters in mid-December 2023. Delivery of these e-scooters was scheduled to commence in early 2024.

Kinetic Green was given the opportunity to present their defense when the lower court initially turned down Yulu Bikes’ request for an injunction. Yulu Bikes, not happy with the result, filed an appeal with the Karnataka High Court.

The legal team for Kinetic Green Energy said in their defense that Sulajja Firodia Motwani, the company’s founder and CEO, was the driving force behind the decision to use the marks “ZULU” or “Kinetic Green-ZULU” and the marketing plan for the introduction of the electric scooters under this brand. They emphasized that the reason “ZULU” rhymes with Sulajja’s moniker, “Sulu,” is why the tagline “Sulu Ki ZULU” was selected. They also emphasized that Kinetic Green had only used four letters in the names of all of its prior goods. They added that the mark was registered prior to its application in the product’s introduction.
