LML Parent company SG Corporate Mobility Pvt Ltd., has filed a lawsuit before the Delhi High Court against Bajaj Auto Ltd. for the unauthorized use of the trademark ‘Freedom’ in their recently launched Bajaj Freedom CNG motorbikes.
This is not the first time ‘FREEDOM’ is being used for motorbikes. In 2002, LML Ltd. launched its motorbikes bearing the trademark ‘FREEDOM’ which was a massive success in the Indian market and still carries an immense goodwill and reputation in the minds of the public at large which is solely associated with LML Ltd. The iconic trademark ‘FREEDOM’ along with the trademark ‘LML’ were assigned to SG Corporate Mobility Pvt. Ltd. in 2021 by LML Ltd. along with goodwill and reputation associated with the mark ‘FREEDOM’.
LML Freedom was known for its durability, style, and exceptional performance, which made it a popular choice amongst Indian consumers for many years. Even today, LML Freedom bikes can be seen on Indian roads, symbolizing the lasting trust and recognition that the brand has earned.
Ever since the trade marks ‘LML’ and ‘FREEDOM’ were assigned to SG Corporate Mobility Pvt Ltd. SG Corporate Mobility is determined to safeguard the integrity of the ‘Freedom’ brand while actively working towards the launch of new scooters and motorcycles under this revered label through its sister concern LML Emotion Pvt. Ltd. In 2022, SG Corporate Mobility announced its strategic collaboration with Saera Electric Auto which used to manufacture Harley Davidson motorcycles in India. SG Corporate Mobility is fully geared to enter into the two-wheeler industry by using the manufacturing facility of Saera Electric Auto in Bawal, Haryana by reclaiming and taking forward the legacy of ‘LML’ and also the ‘FREEDOM’ brands.
In 2022, SG Corporate Mobility also unveiled the launch of its LML Star electric scooters which is its first step into entering and changing the two-wheeler market with its state of the art design and technology by tapping into green and renewable energy sources.
The lawsuit against Bajaj Auto Ltd., underscores SG Corporate Mobility’s firm stance on protecting its intellectual property rights. According to SG Corporate Mobility, Bajaj’s use of the ‘Freedom’ mark on its motorcycles violates its statutory trademark rights and dilutes the established reputation which is associated with LML Freedom motorbikes.
The company’s efforts are aimed at ensuring that the next generation of riders can experience the same sense of freedom and reliability that made LML Freedom a household name. The brand has ambitious plans to launch a new line of scooters and motorbikes under the historic ‘Freedom’ label, along with the ‘LML’ brand. As part of their efforts to relaunch these iconic names.
The lawsuit filed before the Delhi High Court against Bajaj Auto Ltd. is currently pending. SG Corporate Mobility Ltd. is being represented by the law firm Anand And Anand through Advocate Pravin Anand, Advocate Jaya Negi, and Advocate Yashi Agrawal.
