U.S. DOT Updates NEVI Program Rules for EV Chargers

U.S. Transportation Secretary Sean P. Duffy has unveiled revised guidance for the National Electric Vehicle Infrastructure (NEVI) Formula Program. The updated interim final guidance is designed to streamline permitting, reduce red tape, and give states more flexibility in deploying EV chargers nationwide, aiming to hit the goal of 500,000 public fast chargers by 2030.

The sweeping changes simplify compliance requirements for both state governments and private sector partners, aiming to accelerate the pace of charger installation. Early in the year, the DOT revealed that a whopping 84% of NEVI funds remained unobligated, which underscored the urgency for this update.

Under the new rules, states must submit their EV Infrastructure Deployment Plans within 30 days. The guidance limits plan content to only statutory and regulatory essentials, while easing community engagement requirements.

Additionally, states can now set flexible station spacing along Alternative Fuel Corridors, downplay grid integration and renewable energy considerations, and prioritize locations where site operators also own the land, which should speed up project delivery.

Notably, earlier mandates for community equity, transparency, resiliency, and measures such as emergency planning, environmental siting, and underserved community outreach have been rescinded.

The updated NEVI guidance, effective immediately, follows a period of program pause and legal challenges. While the changes raise concerns about equity and comprehensive planning, proponents argue that they remove obstacles and could help states build EV charging networks more quickly.
